SCHOOL GRAND DREAM PROMOTION TERMS AND CONDITIONS

Introduction

These Terms and Conditions ("Terms") apply to the School Grand Dream Promotion ("Promotion") offered by Yamaha Music Australia Pty Ltd ACN 004 259 527 (“YMA”, "we", "us", "our") to participating eligible customers.

By participating in the Promotion, you agree to these Terms.

Promotion Period

Subject to these Terms, the Promotion is valid from 01/06/2025 to 31/12/2025 ("Promotion Period"). Purchases made outside the Promotion Period are not eligible for the Promotion.

References to time are to the time in Melbourne, Australia.

Eligibility

1. The Promotion is open exclusively to accredited Australian primary and secondary schools that purchase an Eligible Product from an authorised Yamaha dealer within the Promotion Period (for a list of YMA authorised dealers, please see our website: https://au.yamaha.com/en/dealers ).

2. To be eligible, the purchasing school must:

   • Be an accredited primary or secondary educational institution recognised by the relevant Australian State or Territory Department of Education.
   • Hold a valid accreditation number issued by the appropriate education authority, including but not limited to:
   • Victoria: Victorian Registration and Qualifications Authority (VRQA)
   • New South Wales: New South Wales Education Standards Authority (NESA)
   • Queensland: Queensland Non-State Schools Accreditation Board
   • South Australia: Education Standards Board (ESB)
   • Western Australia: School Curriculum and Standards Authority (SCSA)
   • Tasmania: Office of the Education Registrar (OER)
   • Australian Capital Territory: ACT Education Directorate
   • Northern Territory: Department of Education NT
     (“Eligible Schools”)
3. For the avoidance of doubt, the Promotion is not available to any of the following:
   • Tertiary institutions (e.g., universities, TAFEs, private colleges).
   • Private music schools, studios, or individual educators.
   • Educational providers or organisations that do not hold a valid primary or secondary accreditation number.

Eligible Products

1. he “Eligible Products” in the Promotion are:
   • Yamaha CX/SX/CF Series Grand Pianos (C1X, C2X, C3X, C5X, C6X, C7X, S3X, S5X, S6X, S7X, CF4, CF6, CFX)
   • All equivalent Colour, Silent, TransAcoustic and Disklavier models
2. The Eligible Product must be:
   1. Purchased from an authorised Yamaha dealer within the Promotion Period.
   2. Registered by the authorised Yamaha dealer within the YMA Dealership Portal within the Promotion Period.
   3. Paid for in full by the Eligible School within the Promotion Period.
   4. In stock and available for delivery at the time of purchase.
3. Employees and contractors of YMA and their immediate family members are not eligible to participate in the Promotion.

Promotion Offer

1. Eligible Schools that purchase an Eligible Product during the Promotion Period and who otherwise comply with these Terms are entitled to select approved Yamaha musical instruments, accessories, and/or audio equipment (“Bonus Equipment”) with a total value of up to $5,000 (inclusive of GST) at Recommended Retail Price (RRP) as advised by YMA for the purposes of the Promotion.
2. The Bonus Equipment:
   1. Must be chosen from a pre-approved list of Yamaha products provided and published by YMA as part of the Promotion.
   2. Cannot be exchanged for cash, credit, or any other form of compensation.
   3. Must be claimed in accordance with the Redemption Process.
   4. Is subject to availability at the time of redemption.
   5. Must be ordered in a single transaction; partial or multiple submissions will not be accepted.
3. Any unclaimed portion of the $5,000 value will be forfeited.
4. If an Eligible School selects an item/items that exceeds the $5,000 bonus value (e.g. a $7,000 RRP timpano), they may opt to pay the difference, up to an additional sum of $5,000 (including GST). The Eligible School will be invoiced for the excess amount above the sum of $5,000 (including GST), which must be paid in full before the Bonus Equipment is shipped.
5. Additional freight charges may apply for items classified by YMA in its absolute discretion as ‘bulky’, including but not limited to acoustic pianos and Clavinova Grand Pianos.

Redemption Process

1. To claim the Bonus Equipment, Eligible Schools must:
   1. Purchase and pay for the Eligible Product in full during the Promotion Period;
   2. Within 90 days of the date of the invoice for the Eligible Product, submit a Claim Redemption
   3. Form to YMA containing the information required by YMA in its absolute discretion (including as notified in the Claim Redemption Form);
   4. Provide proof of purchase as directed by YMA and/or the Claim Redemption Form (as directed by YMA), including a receipt or invoice number evidencing:
      1. that the Eligible Product has been paid for in full;
      2. that the Eligible Product is in stock and available for delivery;
      3. the date of purchase and payment, the name of the YMA authorised dealer, together with the model number and a valid serial number;
   5. At the time of submitting the Claim Redemption Form, select up to $5,000 worth of Bonus Equipment.
2. Claim Redemption Forms received by YMA more than 90 days after the date of invoice for the Eligible Product will not be accepted. Incomplete Claim Redemption Forms will not be accepted.
3. YMA reserves the right to validate purchase details and request further documentation if required.orde
4. Bonus Equipment will be shipped to the Eligible School’s registered address within 60 days after YMA confirms that the claim has been accepted.
5. If any items are backordered, YMA will notify the Eligible School of the expected delivery timeframe. Backordered items will be shipped as soon as they become available.
6. YMA will pay the freight for the Bonus Equipment to be shipped to the Eligible School, subject to paragraph 5(e) above.

General Conditions

1. This Promotion cannot be combined with any other offer, discount, or promotion.
2. YMA reserves the right to:
   1. Verify the eligibility of all claims.
   2. Reject any claims that do not comply with these Terms.
   3. Substitute the Bonus Equipment with a similar item of equal or greater value.
3. If an Eligible Product is returned after a Bonus Equipment claim has been submitted, the Eligible School must:
   • Notify YMA in writing.
   • Return the Bonus Equipment (if received) or reimburse YMA for the full retail value of the Bonus Equipment, at YMA’s election.

Limitation of Liability

1. To the extent permitted by law, YMA is not responsible for any loss or damage arising from or in connection with the Promotion, including but not limited to delays in assessing any claim or delivering any Bonus Equipment, or the unavailability of any Bonus Equipment.
2. YMA accepts no responsibility for any late or misdirected claims
3. Nothing in these Terms is intended to exclude, restrict or modify any consumer rights which may not be excluded, restricted or modified (by agreement or otherwise) under the Competition and Consumer Act 2010 (Cth) ("CCA") or any other applicable legislation. If the CCA or any other applicable legislation implies a condition, warranty or term into these Terms or provides statutory guarantees in respect of goods and services supplied (if any), then YMA's liability for breach of such a condition, warranty, other term or guarantee is limited to the repair or replacement of the relevant goods or the resupply of the relevant services.

Privacy

1. Any personal information collected for this Promotion will be handled in accordance with our Privacy Policy, available at https://au.yamaha.com/en/privacy_policy/index.html
2. By participating in the Promotion, participants consent to YMA using their details for administering the Promotion.

Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the jurisdiction of the courts of Victoria.

Amendments

YMA reserves the right to amend these Terms at any time. Any amendments will be posted on our website and will be effective immediately.
